From 31 January 2023 legal representatives must submit and manage applications for contested financial remedy online using MyHMCTS.

Documents and orders must be uploaded to the online service and will no longer be accepted at local courts.

These changes are included in the pilot Practice Direction 36N which has recently been signed off by the Family Procedure Rule Committee.

A transition period will be in place from Wednesday 1 February to Tuesday 28 February 2023. During this time, HMCTS will continue to process paper applications, until 28 February when they will be returned.

HMCTS have asked us to remind members of this date and that the following guidance is available to assist to ensure minimal disruption:

LawCare, the mental health charity for legal professionals in the UK, this week released new support statistics and its impact report.

LawCare’s 2022 impact report shows that nearly a quarter (22%) of people contacting LawCare for support were primarily concerned about their career in the law. This is a dramatic increase from just over 8% in 2021.

For the first time, the number of people with career concerns equalled the number of legal professionals seeking help because of stress (also 22%).

I know it’s February, but I’ve not spoken to many of you in 2023, so I hope I can just sneak this one in.

Obviously at this time of year our attention turns to our New Year’s resolutions - all the joyful things we are going to do filled with great enthusiasm.

However, before we start doing that let us just keep one thing in mind.  Whilst we do need a plan, whilst we do need a set of actions and whilst we do need very clear aims, there is one absolutely vital ingredient that is necessary to make anything happen.

This philosophy applies to anything that we are likely to be looking at.  Whether it is a long term business plan to help improve our firm, whether it is a software or service implementation that will improve our profitability or indeed whether it is something as simple as some personal aims that we have.

So, for example, a couple of things I am aiming to improve this year are my command of the French language and of course everyone’s favourite - overall fitness.

So, yes of course, I will have a plan for each of them but just to get started I downloaded a really smart French language course by Paul Mason.  Each day I have been doing at last five or ten minutes whilst in the car, whilst getting ready in the morning or while walking to the station.

Fitness - I can put a whole big schedule together of a timetable of the levels that I should be doing and all the different exercises I should be doing but of course to start the ball rolling I renewed my gym membership and went along that very same day and have done so most days since.

So, yes of course, it is important to have a plan and to have targets and to have those wonderful SMART elements within that and everything should be specific, measurable, obtainable, relevant and time based but the one thing everything should have is a very simple mantra and that is JUST TURN UP

So good luck to everyone who has New Year’s resolutions, who has specific targets and aims but do not forget the most important thing in anything of that nature is to JUST TURN UP.

For me, it’s just start to do a few revolutions on the bike, a few kilos of weights, a few words of that lovely French language and for you I hope you can apply this mantra to start those first steps and get into another good habit.

And so, in conclusion Bonne Année et Bonne Chance.
