The SRA has recently issued a guidance note on the importance of effective supervision. It is a timely reminder of what the SRA expects of firms and their managers to comply with their regulatory obligations and also as a matter of good practice.  PII insurers will similarly expect effective supervision procedures to be in place as claims will often arise as a result of lapses in supervision. The guidance identifies a number of key themes including:
  1. The need for supervision
  2. Appropriate supervision arrangements
  3. Conducting supervision
  4. Ensuring supervision is effective
It gives examples of disciplinary case studies where supervision has failed and where significant fines have been imposed as a result. Don’t let this be you!

The Compli team’s experience of carrying out healthcheck audits shows that whilst most firms will have supervision and file review policies and procedures in place, the process fails or is ineffective either because the supervisors don’t have the time to devote to it or it becomes a tick-box exercise. In volume work types especially, we will see clients being passed to a paralegal/non-qualified employee to deal with the claim often without any evidence of input from the qualified supervising lawyer.

Ask yourself:
  1. Are our supervisors appropriately qualified and experienced in the relevant area of law?
  2. Do our supervision arrangements take account of the risks and impact to clients, the nature of the work and the level of experience/qualifications needed to do the work?
  3. Are the supervisors supportive, available and approachable and do the supervisees feel able to speak openly about problem cases?
  4. Do we do what we say we do in regard to supervision? How do we know for sure?
Compli’s risk and compliance healthcheck will help you answer these and many more questions so get in touch with us now for a free, no obligation discussion at compli@weightmans.com
